Welcome to Niafari ("we", "us", "our"), accessible via the website and mobile application at app.niafari.com (the "App" or "Service"). These General Terms and Conditions ("Terms") govern your access to and use of the Niafari Service. By accessing, browsing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

Niafari is an AI-powered travel planning tool that allows users to generate personalized travel itineraries ("Itineraries") based on user inputs such as destinations, dates, preferences, budget, interests, and other details. The Service may suggest activities, accommodations, transportation options, dining recommendations, routes, and other travel-related ideas (collectively, the "Suggestions").

The Service is provided for informational and planning purposes only. Niafari does not own, operate, manage, control, or provide any travel services, including but not limited to flights, hotels, tours, transportation, attractions, restaurants, or other suppliers (collectively, "Third-Party Providers").

2. User Accounts and Responsibilities

To use certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate, current, and complete information.

You are solely responsible for verifying the accuracy, suitability, availability, pricing, and any restrictions of any Suggestions or Itineraries before making any decisions or bookings. Travel conditions, prices, availability, visa/entry requirements, health/safety advisories, and other factors change frequently.

3. No Booking or Transaction Services

Niafari does not act as a travel agent, booking platform, tour operator, or intermediary for reservations. The App does not facilitate, process, confirm, guarantee, or handle any bookings, payments, reservations, tickets, or transactions with Third-Party Providers.

Any links to external websites or Third-Party Providers are provided for convenience only. Your interactions, bookings, or contracts are solely between you and the relevant Third-Party Provider(s), governed by their own terms, conditions, privacy policies, cancellation policies, and liability rules.

4. Important Limitation of Liability – No Responsibility for Bookings or Travel Outcomes

Niafari generates Itineraries and Suggestions based on available data, algorithms, and user inputs, but provides no guarantees regarding their accuracy, completeness, feasibility, safety, or suitability. Information may be outdated, incorrect, or unavailable at the time of your travel.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIAFARI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE OR RESPONSIBLE FOR ANY BOOKINGS, RESERVATIONS, PURCHASES, OR TRANSACTIONS MADE (DIRECTLY OR INDIRECTLY) WITH THE ASSISTANCE OF, OR BASED ON, ANY NIAFARI-GENERATED ITINERARY, SUGGESTIONS, OR OTHER CONTENT PROVIDED THROUGH THE SERVICE.

This includes, but is not limited to:

  • Any failure, cancellation, overbooking, delay, change, or defect in services provided by Third-Party Providers (e.g., no-shows, denied boarding, closed attractions, weather disruptions, supplier bankruptcy, etc.).
  • Any personal injury, death, property damage, loss, additional expenses, inconvenience, or other harm arising from travel planned with or based on the Service.
  • Any errors, omissions, inaccuracies, or reliance on the Itinerary or Suggestions.

You assume all risks associated with your travel decisions and bookings. Niafari expressly disclaims any role as a contracting party or guarantor for any Third-Party Provider services.

5. General Disclaimers

  • The Service and all content (including Itineraries and Suggestions) are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.
  • We do not warrant that the Service will meet your requirements, be error-free, secure, or free from viruses/malware.

6. Limitation of Liability

To the fullest extent permitted by law, Niafari's total aggregate liability (if any) arising from or related to the Service shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim, or USD $100, whichever is lower. In no event shall we be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless Niafari and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

8. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

9. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of The Netherlands, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in Amsterdam (NL).
